Artificial intelligence poses a direct challenge to this principle. This creates a significant legal question: how can an individual provide knowing consent if the organization itself cannot fully articulate how its data will be used to generate an inference, score, or decision?

Simply updating a privacy policy with a vague clause stating “we may use your data for analysis and to improve our services using AI” is unlikely to meet the PIPA standard for meaningful consent. The Office of the Information and Privacy Commissioner for British Columbia has made it clear that consent must be specific and informed. If an AI tool is being used to profile a customer for high-risk marketing or to score a job applicant, the nature of that automated process must be explained. The challenge for businesses is to provide this transparency without overwhelming individuals with technical jargon.

When the Computer Says “No”: Algorithmic Bias and Human Rights

One of the most significant liabilities for a business using AI is not the technology itself, but the discriminatory outcomes it can produce. This is known as algorithmic bias. An AI is only as objective as the data it is trained on. If historical data reflects societal biases, the AI will learn, replicate, and even amplify those biases at scale.

This moves the legal risk beyond privacy law and squarely into the jurisdiction of B.C.’s Human Rights Code. The Code prohibits discrimination in areas such as employment, housing, and public services based on protected grounds, including race, gender, age, disability, and family status.

Crucially, the law does not accept “the algorithm did it” as a defence. The organization that chooses to deploy the tool is responsible for its discriminatory impact, whether intentional or not. Businesses must conduct rigorous due diligence on any third-party AI tools and implement their own testing and human oversight to audit for biased outputs before, during, and after deployment.

Data Governance: The Non-Negotiable Foundation for AI

Artificial intelligence is data-hungry. The more data a model can process, the more accurate its predictions and inferences tend to be. This creates a natural tension with a core privacy principle: data minimization. PIPA mandates that an organization may only collect personal information that is necessary for its stated and reasonable purposes. The drive to “collect everything just in case” to feed future AI projects is directly contrary to this legal obligation.

Furthermore, section 34 of PIPA requires organizations to make “reasonable security arrangements” to protect the personal information in their custody. The more data you collect and the more you centralize it for use in an AI model, the greater the risk and the higher the legal standard for its protection. A breach of a sophisticated AI database is not just a leak of names and addresses; it can also be a breach of highly sensitive inferred data, profiles, behavioural predictions, and classifications that individuals may not even be aware of.

Robust data governance is the prerequisite for any compliant AI strategy. This includes strict data retention and disposal schedules, strong access controls, and a clear data map that identifies what information is being collected, where it is stored, and exactly how it is being used to train or inform AI systems.
